At the outset, the Senior DR informed the bench that the assessee had opted for the “Direct Tax Vivad se Vishwas Act 2020” scheme. The assessee had already submitted Form 1 and Form 2 under the scheme, and Form 5 had been issued by the designated authority. The Vivad se Vishwas Scheme is a dispute resolution scheme introduced by the Government of India to settle pending tax disputes. By opting for this scheme, taxpayers can resolve their tax disputes by paying the disputed tax amount and receiving immunity from interest and penalties.
Given the exercise of this option by the assessee, the appeal was dismissed as infructuous. The ITAT bench acknowledged the appellant’s choice to resolve the tax dispute under the Vivad se Vishwas Scheme and concluded that there was no need to proceed with the appeal.
The appeal by NCR Vehicles Pvt. Ltd. against the order of the CIT(A)-6, New Delhi, was dismissed as infructuous following the appellant’s application under the Vivad se Vishwas Scheme. The dismissal signifies the resolution of the tax dispute for the Assessment Year 2011-12 under the scheme, thereby providing closure to the matter.
