The Income Tax Appellate Tribunal (ITAT) Delhi Bench ‘E’ pronounced its judgment on the appeal filed by Sonia Goel against the order of the Commissioner of Income Tax (Appeals)-13, New Delhi dated 25.03.2019. The case was heard by Shri R.K. Panda, Accountant Member, and Ms. Suchitra Kamble, Judicial Member, through video conferencing.
The appellant, Mrs. Sonia Goel, filed an appeal for the assessment year 2008-09 against the order of the CIT(A)-13, New Delhi. The appeal was registered as ITA No.5151/Del/2019. The appellant, residing at C-3/2, Prashant Vihar, Delhi, contested the tax arrears determined by the Income Tax Officer, Ward 38(3), New Delhi.
On 09.09.2021, the learned counsel for the appellant submitted a letter requesting the withdrawal of the appeal. The request was based on the appellant’s decision to settle the tax dispute under the Vivad Se Vishwas Scheme, 2020. The appellant provided a certificate under Section 5(1) of The Direct Tax Vivad Se Vishwas Act, 2020, confirming the settlement of the tax arrears for the assessment year under consideration.
The Tribunal noted that none appeared on behalf of the appellant during the virtual hearing held on 29.09.2021. The Senior Departmental Representative (DR), Shri Gaurav Pundir, did not object to the withdrawal request.
In light of the appellant’s request and the lack of objection from the Senior DR, the Tribunal accepted the withdrawal of the appeal. The Tribunal’s decision was announced on the conclusion of the virtual hearing on 29.09.2021.
The appeal by Sonia Goel for the assessment year 2008-09 was dismissed as withdrawn under the Vivad Se Vishwas Scheme. This case highlights the application of the Vivad Se Vishwas Scheme, 2020, which aims to resolve tax disputes amicably.
