In a strategic move, Bellevue Central Park-II Condominium Association decided to settle their ongoing tax disputes for assessment years 2015-16 and 2014-15 through the Vivad Se Vishwas Scheme, leading to the withdrawal of their appeals in ITA No. 65/Del/2019. This case illustrates the application of alternative dispute resolutions in tax matters.
Located in Sector-48, Sohna Road, Gurgaon, the Bellevue Central Park-II Condominium Association faced disputes over tax assessments with the ITO, Ward-2(2), Gurgaon. The disputes pertained to the assessment years 2015-16 and 2014-15, leading to appeals against the orders of CIT(A)-1 and CIT(A)-2 respectively.
The proceedings were held via video conferencing on September 30, 2020, under the bench of Shri G.S. Pannu, Vice President, and Shri Kuldip Singh, Judicial Member. The association, through its advocate Shri Tarun Kumar, submitted a request for withdrawal of the appeals, having decided to settle under the Direct Tax Vivad Se Vishwas Act, 2020. A corresponding certificate was also filed to substantiate this decision.
The Senior DR, representing the Revenue, agreed with the withdrawal. The tribunal accepted this and dismissed the appeals as withdrawn, marking a smooth resolution to the dispute.
This resolution via the Vivad Se Vishwas scheme not only resolves the disputes amicably but also demonstrates the effectiveness of such schemes in reducing litigation and encouraging settlements. It provides a blueprint for other entities in similar situations to consider such peaceful resolutions over prolonged legal battles.
The decision in ITA 65/Del/2019 sets a precedent for tax dispute resolutions, highlighting the benefits of opting for governmental schemes like Vivad Se Vishwas to handle complex tax disputes. This approach not only speeds up the resolution process but also reduces the burden on the judicial system, offering a win-win for both the taxpayer and the government.
