This appeal is filed by the assessee against the order passed by the ld CIT(A)-5, New Delhi dated 25/04/2019 for Assessment Year 2001-02.

The respondent in this case is ITO Ward – 5(1), New Delhi. The assessee did not appear for the hearing but sent an email dated 21/08/2021 indicating their intention to settle the dispute under the Direct Taxes Vivaad se Vishwas Act, 2020, and submitted a copy of Form No. 3.
During the hearing on 29/09/2021, none appeared on behalf of the assessee. However, the email dated 21/08/2021 from the assessee was noted, wherein it was stated that they have opted to settle the dispute under the Direct Taxes Vivaad se Vishwas Act, 2020. The email also included a copy of Form No. 3, supporting their decision to withdraw the appeal.
The ld DR, Shri Gaurav Pundir, Sr. DR, did not object to the withdrawal of the appeal.
After carefully perusing the letter dated 21/08/2021 submitted by the assessee along with Form No. 3 for the assessment year 2001-02, the Tribunal observed that the assessee had indeed opted to settle the dispute under the Direct Taxes Vivaad se Vishwas Act, 2020. In view of this, the appeal of the assessee was dismissed as withdrawn.
In the result, the appeal of the assessee is dismissed.
