The case involves an appeal filed by Vrinda Sales P. Ltd., New Delhi against the order of the Income Tax Officer (ITO), Ward-26(4), New Delhi. The appeal pertains to the assessment year 2010-11 and challenges the levy of penalty under Section 271(1)(b) of the Income Tax Act, 1961.
The appeal was filed by Vrinda Sales P. Ltd. against the order of the Commissioner of Income Tax (Appeals) [CIT(A)], New Delhi dated 18.04.2019. The primary issue in the appeal was the levy of penalty under Section 271(1)(b) of the Income Tax Act, 1961, amounting to Rs.30,000/-, due to non-compliance with notices issued under Sections 142(1) and 143(2) of the Act.
The case was heard before the Income Tax Appellate Tribunal (Delhi Bench ‘S.M.C’) in New Delhi on 16th January 2020. The bench comprised Ms. Sushma Chowla, Vice President. The hearing was conducted through video conferencing.
Vrinda Sales P. Ltd. was penalized Rs.30,000/- for non-compliance with three notices issued under Sections 142(1) and 143(2) of the Income Tax Act. The first notice was dated 10.07.2017, and the second set of notices was dated 06.11.2017. The CIT(A) upheld this penalty, leading to the current appeal by Vrinda Sales P. Ltd.
The appellant’s representative, Ms. Surbhi Goyal, CA, moved an application for adjournment, which was refused due to the smallness of the issue. The respondent was represented by Sh. Pradeep Singh Gautam, Sr. DR. The appellant argued against the penalty on the grounds of non-compliance.
The Tribunal considered the details and found no merit in the complete levy of penalty at Rs.30,000/-. However, it decided to restrict the penalty to Rs.10,000/-. Thus, the grounds raised by the assessee were partly allowed.
The Tribunal partly allowed the appeal filed by Vrinda Sales P. Ltd., reducing the penalty from Rs.30,000/- to Rs.10,000/-. The final order was pronounced on 21st February 2020 by Ms. Sushma Chowla, Vice President.
