The case between Securus Records Management Pvt. Ltd., New Delhi (appellant) and Income Tax Officer, Ward-23(1), New Delhi (respondent) pertains to the Assessment Year (AY) 2009-10. Securus Records Management Pvt. Ltd. filed its income tax return for AY 2009-10. However, the Income Tax Officer (ITO), Ward-23(1), New Delhi, raised certain disputes regarding the tax liability. The appellant company decided to settle the dispute under the Direct Taxes Vivad Se Vishwas Act, 2020.
The appellant, Securus Records Management Pvt. Ltd., submitted a letter to the ITAT office on 5th February 2021, stating that it had opted for the settlement of the dispute under the Direct Taxes Vivad Se Vishwas Act, 2020 by filing Form Nos. 1 and 2 on 16th June 2020. Subsequently, Form No. 3, as per Section 5(1) of the Vivad Se Vishwas Act, 2020, was issued to the appellant company by the Department on 16th January 2021.
The respondent, represented by Shri Farat Khan, Senior Departmental Representative (DR), agreed with the appellant’s contentions and the facts presented regarding the settlement under the Vivad Se Vishwas Act.
In view of the above facts, the ITAT decided to dismiss the appeal as withdrawn. The Tribunal acknowledged that the dispute had been settled under the Direct Taxes Vivad Se Vishwas Act, 2020, and hence, there was no need for further proceedings.
The appeal by Securus Records Management Pvt. Ltd. against the Income Tax Officer, Ward-23(1), New Delhi, was dismissed by the ITAT. The Tribunal concluded that the case was settled under the Direct Taxes Vivad Se Vishwas Act, 2020, and therefore, the appeal was withdrawn.
Order pronounced in the open court on 1st March 2021.
