During the hearing, the appellant submitted that it had opted to settle the dispute under the Direct Taxes Vivad se Vishwas Act, 2020. The appellant provided a copy of Form No. 5 issued by the Principal Commissioner of Income Tax (Pr. CIT), Delhi-8 on 22nd October 2021. The appellant requested that the appeal be treated as withdrawn.
The ITAT Delhi ‘H’ bench, consisting of Dr. B. R. R. Kumar, Accountant Member, and Shri Anubhav Sharma, Judicial Member, heard the case on 20th July 2022. The respondent, represented by the Senior Departmental Representative (DR) Shri M. Baranwal, had no objections to the withdrawal request.
The ITAT carefully reviewed the letter submitted by the appellant along with Form No. 5 issued by the Pr. CIT, Delhi-8. In view of the settlement under the Vivad se Vishwas scheme, the Tribunal accepted the appellant’s request and dismissed the appeal as withdrawn.
The ITAT Delhi ‘H’ bench dismissed the appeal filed by Win Medicare Pvt. Ltd. for the assessment year 2017-18 as withdrawn, following the settlement of the dispute under the Direct Taxes Vivad se Vishwas Act, 2020.
