In the proceedings of ITA No. 22/DEL/2019, along with related appeals for various other assessment years, Gates India Pvt. Ltd., headquartered at C-434, Defence Colony, New Delhi, engaged in a crucial legal decision to resolve its tax disputes under the Vivad Se Vishwas Scheme, 2020. The appeals were initially filed against orders from the learned CIT(A) for assessment years 2015-16, 2013-14, 2014-15, and 2012-13.
The tribunal session, presided over by Shri G.S. Pannu, Vice President, and Shri Amit Shukla, Judicial Member, was conducted through video conferencing. On November 27, 2020, the legal counsel for Gates India, Shri Rishabh Malhotra, submitted a request for withdrawal of the appeals, facilitated by a certificate confirming the company’s participation in the Vivad Se Vishwas Scheme.
The Senior DR, Shri M. Baranwal, raised no objections to the withdrawal, leading to the acceptance of the request by the tribunal. This decision allowed Gates India to effectively settle its pending tax issues without prolonged litigation, marking a strategic move towards efficient tax dispute resolution.
This case illustrates the potential of government schemes like Vivad Se Vishwas to provide a mutually beneficial resolution framework for both taxpayers and the tax authorities.
